AR 1312.3 Uniform Complaint Procedures

Personnel/Employee Complaints (Not UCP, for Employees) Misapplication of policy, whistleblower, working conditions (not discrimination)

Start informally with supervisor. If not resolved, submit written within 60 days. Written Complaint

File in 60 days; site investigates in 10 days and responds in 5. District/superintendent/board appeals possible per timelines. Appeal to Superintendent and Board. Board’s decision is final

AR 4144/4244/4344 Complaints

Complaints Concerning District Employees (Students/Community) Any complaint about a district employee (not discrimination/harassment)

Prefer direct informal resolution. Otherwise, submit written complaint to supervisor or principal. Written Complaint

Notice to employee within 5 days. Investigation in 30 school days. Appeals to superintendent then board. Appeals go to Superintendent, then Board (decision is final)

AR 1312.1 Complaints Concerning District Employees

Nondiscrimination/Title IX (Students/staff) Sexual harassment, discrimination by protected category (sex, gender, Title IX, etc)

Report to Title IX Coordinator, Principal, supervisor, or compliance officer. Link

Begin investigation in 5 days (staff), 10 days (students). Findings/report in 30 business days (staff). Board appeal in 10 days (staff). External appeals to OCR/EEOC/CRD

AR 5145.3 Nondiscrimination/Harassment (students); AR 5145.7 Sexual Harassment (students); AR 4030 Nondiscrimination in Employment; AR 4119.12/4219.12/4319.12 Title IX Sexual Harassment (staff)

Williams Complaint (Employees, Students/Community) Insufficient instructional materials, unsafe or unclean school facilities, teacher vacancy or misassignment; also for PE minutes and certain other “conditions of learning”

Use District’s Williams Complaint Form; may be submitted anonymously to the Principal or designee; may also use UCP process English Spanish

Investigation must begin within 10 school days; district must remedy valid complaint within 30 working days; response to complainant within 45 working days if requested Appeal to CDE within 30 days if dissatisfied with district’s decision
