Reaffirming Oxnard Union High School District as a Safe Place School District for Students and Families Threatened by Immigration Enforcement

WHEREAS, Oxnard Union High School District is dedicated to fostering the success and well-being of every student, regardless of their immigration status, ethnicity, race, religion, sexual orientation, gender identity, ability, socio-economic background, or beliefs;

WHEREAS, the Oxnard Union High School District recognizes the significant, unjust challenges faced by undocumented, immigrant students and their families, particularly during times of heightened political and social scrutiny;

WHEREAS, undocumented students and students from immigrant or mixed-status families are an integral part of the Oxnard Union High School District community, deserving of equitable opportunities and protections;

WHEREAS, the Oxnard Union High School District has a long-standing commitment to equity, civil rights, and maintaining schools as sanctuary spaces free from discrimination or enforcement actions that may disrupt educational environments;

WHEREAS, in Plyler v. Doe (1982), the United States Supreme Court held that all immigrant children are people “in any ordinary sense of the term” and hence protected from discrimination under the 14th Amendment, and that all children, regardless of their immigration status, have the right to a free public education;

WHEREAS, the California Constitution, Article 1, Section 28(f)(1) states, “All students and staff of public primary, elementary, junior high, and senior high schools, and community colleges, colleges, and universities have the inalienable right to attend campuses which are safe, secure, and peaceful;”

WHEREAS, the Oxnard Union High School District adopted BP 5145.13 on October 10, 2018. This policy informs the work of District employees as they work with students who are immigrants and their families.

NOW, THEREFORE, BE IT RESOLVED, that the Oxnard Union High School District and its Board of Trustees strongly reaffirms its unwavering commitment to equity, safety, and educational success of every student in the district.

BE IT FURTHER RESOLVED, that the Oxnard Union High School District will not solicit or collect information regarding the citizenship or immigration status of students or families, except as required by judicial warrant.

BE IT FURTHER RESOLVED that the Oxnard Union High School District will not cooperate with immigration enforcement actions at school sites, except as required by judicial warrant. .

BE IT FURTHER RESOLVED, that the Superintendent will develop a comprehensive plan to implement and communicate this commitment, including training for staff on responding to inquiries or enforcement actions by federal immigration personnel and communication with families about the district’s safe place policies in the languages they speak, ensuring broad understanding and access to resources.

BE IT FINALLY RESOLVED, that this resolution be distributed in English, Spanish and Mixteco to educational partners to ensure transparency and inclusivity.

ADOPTED this 29th day of January 2025 that the Board of Trustees of Oxnard Union High School District reaffirms Oxnard Union High School District as a Safe Place School District for Students and Families Threatened by Immigration Enforcement.
